Tegemoetkoming Ondernemers Getroffen Sectoren (TOGS)

Op zaterdag 28 maart maakte het ministerie van Economische Zaken en Klimaat (EZK) bekend dat extra groepen ondernemers in de non-food-sector, zoals winkeliers, vanaf maandag 30 maart 2020 ook gebruik kunnen maken van de regeling Tegemoetkoming Ondernemers Getroffen Sectoren COVID-19 (TOGS).

Minister Eric Wiebes en staatssecretaris Mona Keijzer (EZK) hebben hiertoe besloten op basis van de sinds vrijdag gedane aanvragen voor de TOGS en de recente acute, negatieve ontwikkelingen van winkelomzetten.

"Het zijn uitzonderlijke tijden die grote gevolgen hebben voor ondernemers. Daarom heeft het kabinet bij de aankondiging van het Noodpakket voor banen en economie ook meteen gezegd dat dit pakket nooit stilstaat. Ondernemers in de sector non-food kunnen weliswaar openblijven, maar zien hun inkomsten sterk teruglopen door de noodzaak tot social distancing. Omdat ze hard getroffen worden verruimen we de regeling", aldus de bewindspersonen van EZK

Eenmalige gift van 4.000 euro om eerste vaste lasten te kunnen betalen

Via de regeling TOGS kunnen ondernemers een eenmalige tegemoetkoming van 4.000 euro netto krijgen waarmee ze hun vaste lasten betalen, zoals bijvoorbeeld de huur van een bedrijfspand. Voor doorlopende kosten voor personeel heeft het kabinet andere maatregelen getroffen die ook onderdeel uitmaken van het Noodpakket voor banen en economie. Op de website van de RVO  staat welke ondernemers gebruik kunnen maken van de TOGS-regeling. De lijst met branches en sectoren wordt maandag 30 maart geactualiseerd.

Maatwerk bij criteria SBI-codes

Ondernemers die recht hebben op de TOGS-regeling, maar zien dat zij geregistreerd staan onder een andere zogenoemde SBI-code in het Handelsregister kunnen dit melden bij uitvoeringsorganisatie RVO.nl. 

Wiebes en Keijzer laten weten: "Als ondernemers door een verkeerde registratie tussen wal en schip dreigen te vallen, zullen we dat per geval bekijken. Die flexibiliteit is er. Nogmaals: het zijn uitzonderlijke en ruige tijden, daarom doen we wat nodig is’".

On Saturday 28 March, the Ministry of Economic Affairs and Climate Policy [Economische Zaken en Klimaat] (EZK) announced that additional groups of entrepreneurs in the non-food sector, such as retailers, will also have access to the Compensation for Entrepreneurs in Affected Sectors COVID-19 [Tegemoetkoming Ondernemers Getroffen Sectoren COVID-19] (TOGS) scheme from Monday 30 March 2020.

Minister Eric Wiebes and State Secretary Mona Keijzer (EZK) came to this decision based on the applications for the TOGS submitted since Friday and the recent acute, negative developments in retail turnover.

“These are exceptional times that are having huge consequences for entrepreneurs. For this reason, when the government announced the Emergency Package for jobs and the economy, it said at the same time that this package would never be final and unalterable. Although entrepreneurs in the non-food sector can stay open, they are seeing their income decline sharply due to the need for social distancing. Because they are being hit hard, we are expanding the scheme”, the Minister and State Secretary said.

One-off payment of 4,000 euros to cover initial fixed costs

Through the TOGS scheme, entrepreneurs can obtain a one-off compensation payment of 4,000 euros to pay their fixed costs, such as the rent for commercial premises, for example. The government has adopted other measures for ongoing personnel costs. These measures are also part of the Emergency Package for jobs and the economy. The Netherlands Enterprise Agency (RVO) website (in Dutch) lists the entrepreneurs that can make use of the TOGS scheme. The list of industries and sectors was updated on Monday 30 March.

Individual treatment for SBI code criteria

Entrepreneurs that are eligible for the TOGS scheme, but discover that they are registered under a different Standard Industrial Classification (SBI) code in the Commercial Register, can report this to the implementing organisation RVO.nl.

Wiebes and Keijzer stated: “If entrepreneurs risk falling between two stools due to an incorrect registration, we will look at each case individually. There is flexibility. Once again: these are exceptional and tough times, and therefore we are doing what is necessary.”
